FULL CONTEST RULES (“Contest Rules”)
All contests (the “Contest“) are hosted by Streets Of Toronto Giveaways (“SoT Giveaways“) and is governed by these Contest Rules. The Contest is limited to Ontario residents and is governed by the laws in force in Ontario and the federal laws of Canada applicable in that province. Eligibility for participation is set out below. By participating or attempting to participate in the Contest, each entrant (an “Entrant”) will be deemed to have received, understood, and agreed to these Contest Rules. Only Entrants who abide by the Contest Rules are eligible to win a prize in the Contest. The Contest is limited exclusively to participants who enter through online entries.
Although the Contest may be communicated, promoted, or administered by means of a third party social media or social networking service or site, including TikTok, Facebook, Instagram and Twitter (each a “Third Party Service”), such Contest is in no way sponsored, endorsed or administered by, or associated with, any such Third Party Service.
The Contest Rules may be amended from time to time without prior notice to any Entrants.
Who is eligible to enter a Contest?
The Contest is open only to legal residents of Ontario who are 18 years of age or older at the time of entry.
The Contest is not open to employees, officers, and directors of SoT Giveaways and any of its subsidiaries, affiliates, consultants, agents and representatives, as well as their immediate families and persons living in the same household as such individuals. In addition, any supplier of goods or services to the Contest (including any third party providing the prize(s) awarded in such Contest) is not eligible to enter such Contest, and the same restriction applies to its directors, officers and employees, and their immediate families and persons living in the same household as such individuals. Entry forms submitted on by or on behalf of another person are invalid.
SoT Giveaways reserves the right to verify the eligibility of any Entrant.
How do I enter a Contest?
No purchase is necessary to enter and participate in the Contest. Contest entry may be made by eligible Entrants online at streetsoftorontogiveaways.com.
Each Contest will have a specified start date and time and ending date and time and is denoted on each Contest’s specified page on streetsoftorontogiveaways.com (the “Contest Period”). In its sole discretion, SoT Giveaways may extend the Contest Period. Entrants are required to enter the Contest through the provided form or other method. One entry per person.
SoT Giveaways will not confirm receipt of any entries, and proof of submission of an entry will not be deemed to be proof of receipt. SoT Giveaways has no obligation to advise an Entrant of an incomplete or otherwise non-compliant entry. SoT Giveaways may also cancel or remove the Contest from a Third Party Service at any time without prior notice to Entrants.
Can my entry be rejected by SoT Giveaways?
SoT Giveaways reserves the right to reject or refuse an Entrant’s entry in a Contest if:
- the Entrant attempts to enter a contest in a manner not authorized by, or submits an entry that is not in compliance with, the Contest Rules;
- the entry contains false or misleading information, or is late, falsified, illegible, fraudulent, damaged or incomplete, or otherwise irregular;
- the entry is submitted using robotic, automated, programmed, or other illicit means; or
- the entry contains, depicts, displays, or involves: any crude, vulgar, profane, sexually graphic, offensive, “off-colour”, harassing, threatening, derogatory, demeaning, defamatory, racist, abusive, hateful, violent, obscene, or discriminatory images, depictions, symbols, or material; any illegal statements, material, or content; any material that condones or incites violence, bullying, or other unlawful behavior; any political content or propaganda; or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by SoT Giveaways in its sole discretion.
SoT Giveaways reserves the right to permanently exclude any person from participating in its contests, including the Contest, if such person fails to comply with the contest rules for any contest hosted by SoT Giveaways. This determination will be made by SoT Giveaways in its sole discretion, and will be effective upon SoT Giveaways delivering notice of such determination to the email address or social media account last used by such person to enter a contest.
What is the Prize?
The Contest Prize(s) (each a “Prize”) are denoted on each specified Contest page on streetsoftorontogiveaways.com. Neither SoT Giveaways nor any other of the released Parties (as defined below) makes or provides any representation, warranty, condition or covenant, express or implied, in respect to any Prize provided in connection with the Contest, including without limitation any warranty or condition of merchantability or fitness for purpose, or as to the functionality, suitability, quality, fitness, compliance with safety requirements and standards, operability or defects. A Prize is neither refundable nor transferable, and is awarded “as is”. Portions of the Prize may not be suitable for all ages and may be subject to specific instructions, conditions, and limitations on the use of the Prize. Note that all applicable taxes are the sole responsibility of the Winning Entrant. A Prize must be accepted as awarded and no cash equivalent will be available. No substitution of a Prize is permitted except by SoT Giveaways in its sole discretion. SoT Giveaways reserves the right to substitute an alternate prize of equal or greater retail value, as determined in its reasonable discretion. A Prize is not redeemable for cash or credit, in whole or in part. All Prizes are awarded on an “as is” basis. A Prize winner is solely responsible for all costs not expressly described herein, including but not limited to (except if otherwise specified or provided in the discretion of SoT Giveaways) pick-up, transport, delivery, assembly, and installation of a Prize. A Prize winner is prohibited from profiting from the sale of a Prize.
How will the potential winner(s) be selected?
The potential winner(s) of the Contest (each a “Selected Entrant”) will be selected by random selection. A Selected Entrant will only be declared a winner (a “Winning Entrant”) if:
(i) the Selected Entrant correctly answers, unaided, a mathematical skill-testing question,
(ii) the Selected Entrant completes, signs, and returns a Release (as defined below); and
(iii) the Selected Entrant is found to be fully in compliance with these Contest Rules, as determined by SoT Giveaways, in its complete discretion.
A Selected Entrant who has not successfully filled all the mandatory fields of a Release will be deemed to have forfeited becoming a Winning Entrant and the Prize and SoT Giveaways shall be entitled to select a new Selected Entrant in his/her/their place from the qualified Entrants. Failure to respond or accept delivery of a Prize within two days (48 hours) after notification or return of e-mail notification as undeliverable after two (2) attempts will result in forfeiture of a Prize and SoT Giveaways shall discard the selected entry and be entitled to randomly select an alternate winner. Each Prize will be delivered to the applicable Winning Entrant at the address submitted by the winner upon entering the Contest. If the Prize is returned as undeliverable, the Selected Winner will be deemed to have forfeited the Prize. Each Selected Entrant will be contacted by e-mail and will be required to complete and return the Release in order to redeem his/her/their Prize. Additionally, in order for the selected entrant to claim the Prize, the Selected Entrant must successfully answer a skill testing question correctly, independently, and without aids or assistance from any other party, within a prescribed period of time.
What is the Release and how do I complete it?
Prior to being declared a Winning Entrant, a Selected Entrant is required to execute and return a legal declaration and release form (the “Release”), which, among other things:
- confirms the Selected Entrant’s eligibility and compliance with the Contest Rules;
- acknowledges acceptance of a Prize as offered; and
- indemnifies and releases SoT Giveaways, any applicable Third Party Service, and their respective subsidiaries, affiliates, and/or related companies and each of their respective employees, directors, officers, suppliers, representatives and agents (collectively, the “Releasees”), from any and all liability for:
- any personal injury, death, damage to or loss or destruction of property;
- any falsified, stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, jumbled, or garbled entries, transmissions, email, mail, or other communications;
- any error, omission, interruption, defect or delay in transmission, processing, or communication;
- any inability of a potential Entrant to successfully enter the Contest for any reason;
- the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise;
- failures or malfunctions of, or difficulties with, computer hardware or software, telephones, telephone lines, telephone systems, or network, cable, satellite, server, or website connections;
- printing, typographical, or other errors appearing within the Contest Rules, or in any advertisements or materials related to the Contest;
- any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind;
- incorrect or inaccurate information, including where caused by website users, tampering, hacking, or by any equipment or programming associated or used in connection with the Contest;
- any failure of any website or any platform during the Contest;
- injury or damage to any computer or other device resulting from or otherwise related to participation in the Contest, the use of any website, or the downloading or accessing of any materials; or
- any other errors, problems, or difficulties of any kind, whether human, mechanical, electronic, or otherwise, relating in any way to the Contest, including those errors, problems, or difficulties that may relate to the administration of the Contest, the processing of entries, the advertising of the Contest, or the announcement of any Prize or the identity of any Selected Entrant or Winning Entrant.
If the executed Release is not returned within 2 days (48 hours) from when provided to a Selected Entrant, the Selected Entrant will be disqualified and the associated Prize will be forfeited. In accordance with the Contest Rules, SoT Giveaways, in its sole discretion, may select another Selected Entrant, and award the Prize to such Selected Entrant if they are declared a Winning Entrant. Further, each Release shall continue in force following the termination of the Contest.
What are the odds of winning a prize?
The odds of winning a Prize depend on the number of Prizes and the number of valid entries received in the Contest in which such Prize is being offered.
How does a winner claim a prize?
A Winning Entrant will be notified within two days (48 hours) of his/her/their selection, and must reply within two days (48 hours) of being notified, unless otherwise specified in the Short Rules.
How are prizes distributed?
In the event that any Prize is provided via a third party to a Winning Entrant, SoT Giveaways accepts no liability for any undue delay in the distribution of such Prize. If a third party will provide the Prize, SoT Giveaways will provide the Winning Entrant’s shipping information for such purpose to the third party following upon completion of the Contest.
Each Winning Entrant must accept the applicable Prize as rewarded, which may not be exchanged for cash or any other product(s) or service(s) except by SoT Giveaways in its sole discretion. SoT Giveaways reserves the right to substitute any Prize with another of equal or greater value.
Except as otherwise indicated by SoT Giveaways, a Winning Entrant must personally take delivery of the applicable Prize as instructed within five days of being notified that the Prize is available or within such other time period as the Winning Entrant may reasonably be advised by SoT Giveaways. SoT Giveaways may mail a Prize to a Winning Entrant’s mailing address in Canada. If a Winning Entrant fails to take delivery of any Prize as instructed, such Prize may be deemed forfeited and SoT Giveaways reserves the right, in its sole discretion, to select another eligible Entrant as a potential winner.
How will my personal information be collected, used, and disclosed?
By entering a Contest, each Entrant consents to SoT Giveaways’s collection, use, and disclosure of their personal information as SoT Giveaways deems necessary for the administration of the Contest under the Contest Rules and for promotional purposes, as applicable. Each Entrant agrees that if they become a Selected Entrant or Winning Entrant, SoT Giveaways may disclose and use their personal information (including name, address, telephone numbers, photographs and/or email addresses) without further remuneration, in connection with any publicity carried out by or on behalf of SoT Giveaways.
Personal data submitted online becomes the property of SoT Giveaways. An Entrant may access and obtain a copy of their personal information held by SoT Giveaways upon written request to contests@streetsoftorontogiveaways.com. What laws apply to the Contest?
The laws of the province of Ontario and the federal laws of Canada applicable in that province apply to the Contest and to all entries in the Contest.
Each Entrant agrees that:
- any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or any Prizes shall be resolved individually, without resort to any form of class action, and exclusively by the courts of Ontario;
- any and all claims, judgments and awards shall be limited to actual-out-of-pocket costs; and
- they waive all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket costs.
SoT Giveaways reserves the right to seek any available legal remedy in connection with any attempt to deliberately undermine the legitimate operation of the Contest.
Who makes decisions about the administration of the Contest?
SoT Giveaways reserves the right to make all decisions relating to the administration of the Contest, including the right to terminate, withdraw or amend the Contest or disqualify any entry for any reason. SoT Giveaways may cancel, modify, or suspend the Contest or amend these Contest Rules for any reason whatsoever, at SoT Giveaways’s sole discretion, without advance notice. All such decisions of SoT Giveaways are final and not subject to appeal.
What else should I know about the Contest rules?
In the event of any discrepancy or inconsistency between the terms and conditions of these Contest Rules and disclosures or other statements contained in any Contest-related materials, the terms and conditions of these Contest Rules shall prevail, govern and control to the fullest extent permitted by law. The invalidity or unenforceability of any provision of these Contest Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
- SoT Giveaways reserves the right to disqualify any entrant from the Contest in the event it is determined by SoT Giveaways, in its discretion, that an Entrant (1) has failed to comply with the Contest Rules, (2) has sought to gain an inequitable advantage in relation to other Entrants, (3) has cheated in any way shape or form, or (4) may bring the Contest, SoT Giveaways or any Third Pary Service or any of their affiliates into disrepute.
- Any attempt by an Entrant or any other person to deliberately damage or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws. Should such an attempt be made, SoT Giveaways reserves the right to seek remedies and damages from any such person to the fullest extent permitted by law.
- The parties have expressly required that these Contest Rules and all documents and notices relating hereto be drafted in English. Les parties aux présentes ont expressément exigé que le présente regles de concours et tous les documents et avis qui y sont afférents soient rédigés en anglais. In the event of any discrepancies between the English language rules and the French language rules for this Contest, the English language rules shall prevail.
